JUSTIN A. MARCHETTA


Justin A. Marchetta is a partner of the Firm and leads its Aviation practice group. He represents aircraft owners and operators, pilots, crewmembers, and mechanics in a wide variety of legal matters, including certification, accident and incident investigations, enforcement actions, medical certificate eligibility, and insurance. He regularly counsels aircraft owners and potential owners, and conducts complex domestic and international transactions regarding a wide variety of aircraft from small single engine airplanes up to super-mid and large size business jets. He also represents clients in all aspects of aircraft ownership and operation under both private and commercial operating regulations. Representing on-demand charter companies, fixed-base operators (FBOs), and air tour operators, Mr. Marchetta also counsels aviation businesses in all aspects of their operations. He is a founding member of the New Jersey State Bar Association Aviation Law Committee, and he sits on the board of the Mid-Atlantic Aviation Coalition (MAAC). He also serves as a panel attorney for the Aircraft Owners and Pilots Association (AOPA) Legal Services Plan.

Mr. Marchetta also represents clients in litigated matters before state and federal courts. He represents private clients, public entities and non-profit corporations in a wide variety of matters, including contract and employment disputes, complex commercial litigation, actions in lieu of prerogative writs, zoning and land use litigation, municipal board matters, nonprofit organizations, municipal property tax appeals, insurance, and government investigations. He also has experience in complex transactions, corporate governance matters and non-profit entity formation. Mr. Marchetta, a licensed amateur radio operator (call sign NE2V) and avid radiosport competitor, serves as Volunteer Counsel to the American Radio Relay League (ARRL) representing its members in regulatory, zoning and land use matters.

In the public sector, Mr. Marchetta serves as lead and coordinating defense counsel on matters involving municipal joint insurance funds. He also represents municipalities on a wide variety of issues, including litigation, Open Public Records Act and Open Public Meetings Act, bidding and purchasing, construction appeals, police and emergency services, disaster recovery, insurance, and housing and rehabilitation.

Mr. Marchetta received his B.A. degree from Rutgers College, and his J.D. Cum Laude from Seton Hall University School of Law. While in law school, he served as vice president of the Seton Hall Litigation Society and received best brief author and best oral advocate honors in appellate advocacy. Before attending law school, Mr. Marchetta worked in the public sector for eight years as a 9-1-1 dispatcher and EMT. Prior to joining the firm, Mr. Marchetta worked for four years, first as a full-time law clerk then as an associate, at the law firm Stern & Kilcullen. He also interned for the Honorable Madeline Cox Arleo, U.S.M.J. in the U.S. District Court for the District of New Jersey.

REPRESENTATIVE MATTERS

  • Lead counsel in a complex acquisition and lease-back transaction involving business jet aircraft, with international and subsidiary entity components.
  • Co-counsel in aircraft fractional ownership interest acquisitions with associated management and maintenance agreements.
  • Lead defense counsel in a FAA enforcement action against a commercial pilot, securing a favorable settlement for the pilot allowing him to continue his aviation career.
  • Lead counsel in complex transactions involving the sale and purchase of multiple business jet aircraft with domestic and international component transactions.
  • Lead counsel for a flight instructor in a joint FAA and NTSB investigation regarding a serious aircraft accident.
  • Lead defense counsel in a land use action filed against a New Jersey municipality, obtaining a dismissal of the action as to the municipality, which was sustained on appeal to the New Jersey Appellate Division.
  • Co-lead defense counsel in a CEPA action filed against a New Jersey municipality, obtaining a dismissal of the action as to the municipality.
  • Lead counsel in an investigation by the New Jersey Office of Emergency Medical Services, Department of Health, regarding complaints against a municipal emergency medical services provider, securing a discontinuance of the investigation as to the provider.
  • Associate defense counsel in a contract and employment action involving a community hospital, securing a favorable settlement for the hospital.
  • Lead counsel in a commercial dispute involving a New York manufacturer and an international exporting company, winning a judgment on behalf of the manufacturer.
